Plus LOTS and LOTS of other cars on and off the track.

a local company here called Roaring Fourties is regarded as building the best quality GT40 replica's in the world. i dont know if they keep to the original 40.5 odd inches height the originals had or go for something closer to the 44 inches the new Ford GT has

The GT40 in the first post looks like a replica to me. The intakes and the nose clips are not correct. The wheels/tires look odd and the dimensions seem off as well; the nose is too long.

Two things I see:
The wheels. If it were real, it would probably have knockoffs. I may be wrong, but it's a guess.
Two, the air scoops in the rear are reminiscent of the MKII, with the 427, which was definately not street legal. The only one that was was the MKIII, and that one had a higher front end to make sure the headlights were at the legal limit. It humps a little, but I think the real thing is more pronounced.
Lastly, it was in a parking lot! Real GT40's sell for more than 250K easily, and such a fine example could quite easily see more than that.
