    CARTOON characters are people too, a judge has ruled in the case of a man convicted over cartoons based on The Simpsons, in which children are shown having sex.

    n the New South Wales Supreme Court today, Justice Michael Adams ruled that a fictional cartoon character was a "person" within the meaning of the relevant state and commonwealth laws.

    Alan John McEwan was appealing his February conviction for possessing child pornography and using his computer to access child pornography.
    "The alleged pornography comprised a series of cartoons depicting figures modelled on members of the television animated series The Simpsons," the judge said.
    The cartoons showed characters such as Bart, Lisa and Maggie Simpson having sex.
    McEwan was convicted and fined $3000 and placed on a good behaviour bond.



    "In my view, the magistrate was correct in determining that, in respect of both the commonwealth and the NSW offences, the word 'person' included fictional or imaginary characters ...," the judge said.




    "... The mere fact that the figure depicted departed from a realistic representation in some respects of a human being did not mean that such a figure was not a 'person'."
    In dismissing the appeal, the judge ordered each party to pay its own legal costs in the first case dealing with the "difficult" issue.


    I've found this an interesting conversation point.
    I think its complete bollocks.

    Does this mean the simpsons and 20th century fox studio's are liable for child porn for showing barts parts in the simpsons movie?

    Yeah, I don't know much about anime porn but I know enough that some of those cartoons look quite young. And I know this is weird and its certainly not something I am into but I guess I would rather have these pedophiles and predators watching cartoons than finding and exploiting real kids. However, I also see the law side that this could encourage those people to want to watch real thing after seeing cartoons. Interesting case...

    I guess this means they can marry cartoon characters as well, I mean, they have the same legal rights as people. .....

    Well.. as EyeBefore mentioned, this ruling gives weight to marrying cartoon characters, as that guy in Japan wanted. There was a court case there earlier this year from a guy who wanted to marry a manga character. The guy is obviously tragically messed up, but it's that sort of thing that would mean that this kind of ruling will never happen there.

    That judge is a moron. The point of child pornography laws is to prevent children from being subject to acting in porn, not to dictate what is morally acceptable for someone to do in the privacy of their bedroom as long as nobody is being harmed.

    It seems to be a common problem these days, when what should simply be left as a social norm is turned into a law, at least, here in America. Digi, you definitely just hit the nail on the head in my opinion, as I do not see why this should involve such laws....Much less to declare a drawing to be a person in a legal setting.....

    I agree with the social disgust thats involved in child porn of any kind.

    But given the choice between a weirdo pervert who prefers my offspring or a weirdo pervert wanting to see Milhouse & Lisa Simpson get it on......Things would be all coming up Milhouse.

    Japan is probably ok since british law is not relevant in Japan.

    I think porn is a very big part of japanese culture. i remember reading an interview once that was translated into english between hideki matsui (yankees) and a japanese reporter. I would say the interview was 3/4 baseball, 1/4 porn collection. Apparently matsui owns over a thousand DVD's and apparently the japanese pro baseball players and the media all kinda borrow and trade their porn. but i digress...the point is that porn is much more socially acceptable and not so taboo as it is in the US and apparently England too so I doubt anime will be shut down out there.

    Personally, I think its rediculous. Its a drawing, its not real. Its not being sold to minors and it doesn't "star" any minors because cartoons are not real people! And just for the sake of argument, lets say perhaps since the voices behind the cartoons are real people, that helps make the cartoons real people...the voice actors arent minors!

    the point why I would agree with the judge is that accepting hentai and the likes involving young characters, it would lead to a bigger fruition of it, and, as usual, someone would be surely going to cross the line between the fake and the real word.
    It's something that already happens, perverts translate their obsessions into reality, and giving them even something to fantasy over, it's not helping for sure.

    I wouldn't say that a cartoon is a person, but willing to kill someone (seriously I mean) isn't something innocent at all, even if you are not going to do it (presumingly). so possessing material with cartoon children having sex, it's just a way to say "that's what I like".

    then the difference between a character like Lisa Simpson and an anonymous young girl I think should be clear to everyone, and to a judge too.
    we don't know how that material was, and for the few facts I know, I agree the guy is guilty, and to the fact that from this peculiar point of view a fictional character is equivalent to a real person, but that doesn't imply they actually are person, so say goodbye to marriages and so on.
