Because Apple have taken an unprecedented step and tried to negotiate with EVERY record company from every country they want to allow users of the iPod and iTunes software to download music, they have to enter into seperate contracts etc.
Because some are holding out, some countries don't have iTunes.
As a technical rule, Ripping CD>MP3/Comp is not illegal (Although Windows Media Player 9 or later won't let you rip copy controlled CD's). It's the sharing that they worry about. If the Record company spots you sharing this music (Because you have already bought a hard copy and share it with others) then your in trouble

Yeah well the point is, they can't claim a portion, legally. If the blank tape/ipod/cd makers agree to pay up to the record companies then it's their problem. But, record companies can't legally claim that they HAVE to have a portion of the iPod sales. What he is giong through is EXACTLY what the industry did over cassette tapes. Argued back and forth about the need to pretect "music industry" and the compromised on a reduced fee.
